Sugarcreek Township

RESOLUTION NO. 2004-01-07

IN RE: Preservation of Township Open Space

WHEREAS, this Board of Trustees is steadfastly committed to maintaining the rural character and open spaces of Sugarcreek Township without interfering with positive, sustainable development, for the benefit of all citizens of Sugarcreek Township ;and,

WHEREAS, the Sugarcreek Township Board of Trustees, by previous Resolution # 2001-10-01-08, acquired approximately 50 acres of land within Sugarcreek Township ; and

WHEREAS, the Sugarcreek Township Board of Trustees, by previous Resolution #2001-12-03-07, entered into an agreement to sell approximately 40 acres of that property to the Bellbrook Sugarcreek Park District; and,

WHEREAS, that agreement allows the Park District to pay the purchase price over a ten-year schedule, with annual payments of $50,000.00; and,

WHEREAS ,two payments have been received from the Park District, and a third payment is anticipated to be received after the 2004 first half Real Estate Settlement; and,

WHEREAS, it is proposed that this Board of Trustees shall provide "matching funds" up to an amount equal to the Park District payment (s), from revenue received as a result of Estate Tax payments, for all funds received from the Park District for Calendar Year 2004; and,

WHEREAS, the charter of the Sugarcreek Township Open Space Committee and the funding for preserving open space is viewed as compatible with the objectives of the Bellbrook-Sugarcreek Park District; and,

WHEREAS, it is recognized that the Open Space Committee is the body best suited to recommend the utilization of these funds,

NOW ,THEREFORE, BE IT RESOLVED, that the monies received from the Park Board and those required to match shall be transferred into a separate Open Spaces/"Leave A Legacy" Fund, for appropriate public information actives as well as the eventual acquisition of additional open natural areas,

FURTHER BE IT RESOLVED that donations form other private and public entities are encouraged for this purpose and that citizen input is encouraged to implement this significant green space initiative.
